Construction Defect Division

Wright, Finlay & Zak's ("WFZ") Construction Defect Division handles construction contract disputes, construction defect claims and the personal injury, products liability and property damage claims resulting from construction defects in both residential and commercial projects. WFZ's Construction Defect team is managed by Dana Jonathon Nitz, Managing Partner of our Nevada office, who brings over 30 years in construction contract litigation and over 20 years of experience in construction defect litigation, with its attendant insurance coverage and surety issues. While Dana is located in Nevada, WFZ also has offices in California, Arizona, Washington, Utah and Oregon, and has attorneys who are also admitted in New Mexico, to assist the firm’s construction clientele.

WFZ's construction defect experience includes successfully representing developers, general contractors, subcontractors, and design professionals on thousands of single family homes, common interest communities, condominiums and townhouses, apartments, office buildings, commercial and industrial developments, and high-rise towers. Our experience spans all aspects of construction and design issues involving soils and site preparation, framing, roofing, stucco and EIFS, window manufacture and installation, weatherproofing, paving, concrete, flooring, mechanical, electrical and plumbing. WFZ can also handle the water intrusion and mold resulting from construction defects. Whatever the issue, WFZ will work with the experts in all fields in developing a comprehensive, cost-effective scope of repair and remediation, and implement it directly or coordinate the work with the responsible parties.

Construction defect matters regularly involve many parties and are highly fact-intensive, yet we strive to provide the most economical way of handling these disputes and minimize expenses for our clients. We have the experience to efficiently identify the problem and the responsible parties and their insurers and have the technical background and extensive construction knowledge to focus our team of experts from all fields to evaluate the claimed defects or show why the work meets the plans and specifications, building codes and industry standards. Because defense of these matters does not stop at the jobsite, our experience and knowledge regarding insurance coverage provides a distinct advantage over other firms working in this arena to find first party coverage and pursue indemnity and additional insured obligations from others.

Our approach allows us to obtain the earliest possible resolution of cases by simultaneously minimizing defense costs and indemnity exposure.
