Title Defects/Claims

If a title defect threatens to impair the lender's security, we act aggressively with the lender's ALTA carrier to cure the defect. Often while the title company is considering the claim, we commence the defense (or prosecution as the case may be) to protect the lender's interests pending any title company resolution. We have worked with title company's legal departments for many years in resolving lender's claims, and we are therefore familiar with how claims are handled (or not handled), and we are personally acquainted with many of the people working at the title companies. If there is no title company involved (or the title company denies the claim), our firm will take any and all measures, including the filing of the appropriate legal actions to re-establish your original lien position. In extreme circumstances, we can file a bad faith action against a title company that wrongfully denied your claim.
