Wright, Finlay & Zak ("WFZ") is dedicated to assisting mortgage companies, banks, loan servicers, auto and vehicle finance companies, secured and unsecured creditors in protecting their investments throughout the bankruptcy process. By focusing our attention on each of our clients' unique timelines and needs, our firm ensures effective and prompt preservation, collection and recovery of our clients' assets.

Our Bankruptcy Division is comprised of experienced attorneys and support staff who understand the intricacies of Chapter 7, 11 and 13 cases irrespective of the type of debt serviced (real property loans, auto or vehicle finance, unsecured, etc.). Our knowledge, coupled with our commitment to technology and cost-effective representation, allows our team to effectively handle a high-volume caseload. WFZ routinely manages a variety of pre and post-confirmation matters for our clients, including issues pertaining to relief from stay, dischargeability, lien-stripping, litigation, loan modification review and workout, proofs of claim and review of Chapter 11 and 13 plans of reorganization for issues pertaining to bad faith, feasibility and adequate protection of collateral.

In addition to managing everyday bankruptcy actions, WFZ also handles complex bankruptcy matters while counseling our clients through critical decisions for positive results. WFZ will navigate our clients through complicated Chapter 11 proceedings by providing in depth plan review and assessing cash collateral motions, motions to value, secured debt workouts, adequate protection agreements and cramdowns. Moreover, our Bankruptcy Division handles all litigation matters that arise out of the bankruptcy process including the prosecution and defense of adversary and appellate proceedings involving California and Nevada Homeowners Bill of Rights (HOBR), TILA, RESPA, title claims, fraudulent conveyance claims, bad faith matters, preference actions, violations of the automatic stay and defense of objections to claim. WFZ's Bankruptcy Division provides comprehensive representation in California, Nevada, Arizona, Washington and Oregon, as well as handling complex Adversary Actions in Utah.
